Gardy Companion (“Companion”) is a product of GARDY Technologies Inc. (“GARDY”, “we”, “us”). These Terms of Service govern use of Companion by individual subscribers and people accessing the service through an organizational licence.
Before using Companion, users must review the Privacy Policy and Terms of Service and actively indicate their agreement using the acceptance checkbox. When no acceptance has been recorded, the agreement screen is shown after login. Selecting “I don’t agree” signs the user out without deleting the account or its data; the agreement will appear again if the user returns.
A user who accepts may continue using Companion. The Privacy Policy and Terms remain accessible in the application.
Companion offers AI-supported text and voice conversations, journaling, reflections, personal memory and continuity tools intended to help adults organize thoughts, express experiences and support general emotional wellbeing. Features and usage limits may vary by subscription or organizational plan. Users choose when and what to share.
Companion is not a licensed clinician, medical or psychological service, diagnostic tool, treatment provider, or emergency response service. It does not diagnose conditions, prescribe or change medication, or replace qualified professional care. AI-generated responses may be incomplete or inaccurate and should not be treated as personalized medical advice.
If you or someone else faces immediate danger or an urgent mental-health emergency, contact local emergency services or an appropriate crisis service rather than relying on Companion.
You must provide accurate account information where required, protect your credentials, and notify support@gardy.ca if you suspect unauthorized access. Accounts are for authorized users; do not share access in a way that breaches your plan or an organizational licence. GARDY may apply reasonable security checks and controls to protect users and the platform.
Individual paid plans may be billed through Stripe. Prices, billing frequency, included features and renewal terms are displayed before purchase. Unless otherwise stated at checkout, recurring subscriptions renew automatically until cancelled. You may cancel through the available account billing controls; cancellation normally takes effect at the end of the paid period.
Organizational licences may be purchased and paid for under a separate agreement, invoice, electronic funds transfer or other agreed payment method. The organizational agreement controls its licence quantities, billing and renewal provisions.
Subscription charges are generally non-refundable for unused or partial billing periods, except where applicable law requires otherwise or an applicable organizational agreement provides different terms. Nothing in these Terms limits non-waivable consumer rights.
You retain ownership of content you submit, subject to rights held by others. You authorize GARDY and necessary service providers to process that content to deliver requested Companion functions, maintain security, operate the account and perform the activities described in the Privacy Policy. You are responsible for deciding what personal information to submit.
You may request selective deletion of journal entries, memories or conversations through support@gardy.ca, or delete your account through Profile. Some information may remain in disaster-recovery backups for the applicable retention period.
Do not use Companion unlawfully; attempt unauthorized access; interfere with systems or other users; upload malicious code; impersonate others; circumvent licence limits or security controls; or use the service to harm, threaten or exploit another person. GARDY may restrict access to address misuse or protect service safety.
Organizations may provide Companion licences to authorized users under separate commercial arrangements. Organizational access does not remove an individual user’s ability to read the core Privacy Policy and Terms, or to contact GARDY with privacy questions. Additional organizational terms, support procedures and privacy notices may apply and will be made available where relevant.
We aim to provide reliable access but do not guarantee uninterrupted availability or identical AI outputs. Maintenance, outages, connectivity problems and external service failures may affect features. We may improve, change or discontinue functions, with appropriate notice where required.
We may suspend or terminate access for material violations, security threats, misuse or as permitted by applicable law and agreements. Users may stop using the service at any time. Declining the agreement logs the user out and does not itself delete the account. Account deletion is a separate user action.
Companion is provided as a supportive, non-clinical digital service. To the extent permitted by applicable law, GARDY does not guarantee any particular emotional, health or therapeutic outcome. Liability exclusions or limitations apply only to the extent permitted by applicable law and do not exclude rights that cannot legally be waived.
We may revise these Terms when the service or legal requirements change. Where a change requires renewed agreement, users will be asked to review and accept the applicable Terms before continuing. The service will not treat closing an agreement screen or signing out as acceptance.
These Terms are governed by the laws of Quebec and applicable laws of Canada, subject to mandatory consumer and other legal protections that apply to the user or organizational deployment.
